Nobody can blame them for that, but many companies have resorted to credit checks on job seekers, as a way of screening high risk workers applying for jobs with fiduciary or financial responsibility. </p>

According to Hayes International, a consulting company that specializes in safety and risk control, &quot;shoplifters and dishonest employees stole over $6.0 billion in 2008 from just 22 major retailers.&quot; According to the same survey the rate of dishonest employees rose in 2008 by 21.64%. Businesses seem to be fighting back with more stringent screening processes. </p>
<p>The problem is that millions of Americans are now nursing battered credit scores due to current financial crisis. This situation can create a catch-22 scenario for unemployed workers that have a bad credit rating because they are unemployed and can&#8217;t find employment because of their bad credit rating.    <br />This has brought to question the legality of hiring filters that may not be directly related to a job, but can jeopardize a person&#8217;s chances of finding a job, or getting a promotion. According to the National Conference of State Legislatures, over 16 states are considering legislation that would limit or prohibit the use of credit checks on job applications. </p>
<p>Supporters of this process claim that a solid credit history is an important factor when hiring an employee that will have control over large amounts of cash. However, what can be said of jobs that do not include access to money, and where credit checks on job seekers are just a type of &quot;character screening&quot;.    <br />Opponents to credit checks on job seekers feel this practice is altogether unnecessary and discriminatory. Congressmen Cohen, serving Tennessee&#8217;s 9th District, has authored and is sponsoring HR 3149, The Equal Employment For All Act. According to Cohen&#8217;s website: &quot;This bill would give some of our most vulnerable &quot;credit challenged&quot; citizens – students, recent college graduates, low income families, senior citizens, and minorities – the opportunity to begin rebuilding their credit history by obtaining a job.&quot; In other sections of his website congressman Cohen explains he does not feel credit checks on job seekers should be used as a basis of denying employment to otherwise. However the HR 3149 Act is still pending approval by congress, and could stay there for a long time.</p>
<p>In the meantime what can you do if you feel your chances of finding employment or a receiving a promotion could be affected by credit check? Know your rights. Existing legislation provides limits and requirements for companies that use credit checks on job seekers.     <br />For instance, the federal Fair Credit Reporting Act (amendment September 30, 1997) states that if your employer, or potential employer, uses a third party screening company that carries out credit checks on you they must inform you before they take any adverse action. Once the adverse action (i.e. not getting employed) is taken the employer must provide contact information of the screening company so that you (the applicant) can check the accuracy of the credit report. The only problem is that there are huge loopholes companies can jump through to avoid this legislation.     <br />In any case most employers actually ask their candidates if they will allow them to carry out credit checks on job seekers. Applicants have the option of not allowing the credit checks, but needless to say this will probably end their chances of employment. </p>
